1. Overview

This website is operated by Graffio LLC ("Graffio," "I," "me," or "my"). Throughout the site, the terms "we," "us," and "our" also refer to Graffio LLC. By visiting this site or purchasing from it, you engage with these Terms of Service ("Terms") and agree to be bound by them, including any additional policies referenced here (such as the Returns & Refunds Policy and Privacy Policy). If you do not agree to these Terms, please do not use this site or place an order.

2. The Artwork

Every piece offered for sale is an original, one-of-a-kind work, hand-made in oil pastel on archival paper. Because each work is unique:

  • No two pieces are identical, and slight variations from listing photos are part of the nature of original handmade art.
  • Colors may appear differently depending on your screen. Listing photos are taken in natural light and represented as accurately as possible, but I cannot guarantee that your display reproduces color exactly.
  • Once a piece sells, it is gone. I do not produce prints, copies, or reproductions of sold works unless explicitly stated otherwise in the listing.

3. Pricing and Payment

All prices are listed in U.S. dollars. I reserve the right to correct pricing errors, change prices, or modify or discontinue listings at any time without notice. Payment is processed securely through Shopify and its third-party payment providers; I do not store your full payment details. Your order is confirmed only once payment is received in full.

4. Shipping

Shipping terms, timing, and handling are described on each product listing and in the Returns & Refunds Policy. Title and risk of loss pass to you upon delivery to the carrier. Please inspect your work promptly upon arrival and retain all original packaging in the event of a transit-damage claim.

5. Returns and Refunds

All sales are final. The sole exception is damage in transit, which is handled under the separate Returns & Refunds Policy. That policy is incorporated into these Terms by reference.

6. Intellectual Property and Copyright

This is important, so it's stated plainly: when you purchase a work, you are buying the physical artwork only. You are not buying the copyright.

  • I, Priyanka Parikh, retain full copyright and all reproduction rights to every work, including all sold works, under U.S. copyright law.
  • Purchase does not grant you the right to reproduce, copy, scan, print, publish, distribute, create derivative works from, or commercially exploit the artwork in any form.
  • You may photograph your purchased work for personal, non-commercial purposes (for example, sharing a photo of it hanging in your home). Any commercial use, reproduction, or use of the work or its image for resale of copies requires my prior written permission.
  • All site content — including images, text, listing descriptions, logos, and the names "Graffio" and "P. Parme" — is owned by or licensed to Graffio LLC and is protected by copyright and trademark law. You may not use it without written consent.

7. Resale of Original Works

You are free to resell, gift, or transfer the physical piece you purchased. The copyright and reproduction rights described in Section 6 remain with the artist and do not transfer with resale.

8. Use of This Site

You agree to use this site for lawful purposes only and not to attempt to interfere with its operation, security, or other users' use of it. I reserve the right to refuse service, cancel orders, or limit quantities at my discretion.

9. Accuracy of Information

I work to keep listings, descriptions, and availability accurate, but I do not warrant that all content is error-free, complete, or current. I reserve the right to correct errors and to update information at any time without prior notice.

10. Limitation of Liability

To the fullest extent permitted by law, Graffio LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this site or from any product purchased. My total liability for any claim related to a purchase shall not exceed the amount you paid for the work in question.

11. Indemnification

You agree to indemnify and hold harmless Graffio LLC and its owner from any claim or demand arising out of your breach of these Terms or your violation of any law or the rights of a third party.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in California.

13. Changes to These Terms

I may update these Terms at any time. The current version will always be posted on this page with its effective date. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.
